CONTEST RULES & REGULATIONS

By participating in a contest all persons are deemed to have read and to have accepted these rules and regulations.

Swoop Flight Prize Description:

Round-trip airfare for two  (2)  people from Halifax, NS (YHZ) to one of the following Swoop regularly scheduled, marketed and operated non-stop destinations: Toronto, ON (YYZ), Hamilton, ON (YHM), Ottawa, ON (YOW), Winnipeg, MB (YWG), Edmonton, AB (YEG), or Abbotsford, BC (YXX). Subject to seasonal service and schedule changes.

Winner and his/her guest are responsible for all transportation including transfers to and from Airports, and to and from the hotel, and all other costs, charges, expenses and arrangements not explicitly stated as included herein (“Additional Expenses”). For clarity, all Additional Expenses are solely the responsibility and at the expense of the winner/travellers. Approximate maximum retail value for flights is $1000. CAD. Swoop is not responsible for all or any applicable fees beyond fare and flight taxes. Not included are personal carryon or checked baggage, in-flight entertainment and seat selection fees, and all such fees will be deemed to be Additional Expenses.

Flight Prize Terms & Conditions:

Flight Voucher Prize must be accepted as awarded and may not be transferred, assigned, or substituted except at Swoop’s sole and absolute discretion. Swoop reserves the right to substitute any stated prize (or portion thereof) with an alternate prize of comparable or greater value at its sole and absolute discretion. Flight Prize may not be exactly as advertised, and except as expressly warranted herein, any Flight Prize is provided “as is” without further warranty of any kind.

Flight Travel is valid until December 14, 2022. Eligible Winner will be required to sign a declaration and release, and travel must be booked within 3 months of signing declaration release form. Travel is subject to airline blackout dates, such as, but not limited to; June 28– July 4, 2022; July 28– August 2, 2022; September 1– 6, 2022; September 29 – October 3, 2022; October 6– 11, 2022; November 9 – 14, 2022.

Seats are subject to promotional economy seat availability. No changes to destinations, names, travel dates etc., will be accepted once confirmed. Flight Prize is not valid for any flights departing after such date and extensions to the expiry date are not permitted. Flight Grand Prize must be booked no later than Oct 1, 2022, after which time the prize will expire. Winner and his/her guest are responsible for all transportation (incl. transfers to/from hotel) to and from the gateway airport and all other expenses not stated as included herein. All other taxes, fees and applicable surcharges will be paid by the winner.

Transportation is subject to availability, government restrictions and regulations, airline, airport or other transportation restrictions and regulations. Seasonal service and schedule will apply; certain travel dates may not be available. Swoop is not responsible for unpredictable network changes that cause cancelations, or weather delays or cancelations. All prize details will be determined in the sole discretion of Swoop. Tickets are subject to certain terms and conditions as specified by issuers. Prize Participants must travel together in economy seats on the same itinerary in both directions and are responsible for ensuring they have all necessary travel documents (e.g., valid passport, visas, vaccination records/passports, Covid testing (if applicable) and entry requirements etc.). Swoop Inc. is not responsible in the event any Prize Participant is refused boarding at any time by the airline or airport security. Any unused portion of the prize will be forfeited. Each Prize Participant must be of age of legal majority in his/her jurisdiction of residence. The winner is fully responsible for all other applicable federal, provincial, and municipal taxes (including income and withholding taxes).

Any and all additional costs and expenses associated with prize acceptance and use not specified herein as being provided including but not limited to health insurance, transportation costs, including but not limited to: carry on and checked baggage fees, excess baggage fees, seat selection etc., onboard food and beverage, pre-seat selection, in-flight entertainment, gratuities and other expenses incurred by the winner (and any guests) in claiming, accepting and/or using the prize are the sole responsibility of the winner.

What should I bring?

Surge 105 – CKHY reserves the right to ask contest winners to provide adequate identification to claim any prize won through Surge 105 – CKHY (valid driver’s license, passport, or other government ID). Cannot exchange prize. The prize(s) must be accepted as awarded. No substitutions, or exchanges. An alternate prize of equal or greater value due to unforeseen circumstances may be awarded. The radio station is not responsible for replacing tickets in the event of cancellations as a result of weather, promoter, performer, or other reasons beyond our control.

How long do I have to pick up my prize?

Prizes must be claimed within 30 days of winning unless otherwise noted in the contest rules. Certain prizes, such as a concert, or show tickets may not be available immediately following the completion of the contest. Surge 105 – CKHY guarantees that they will be available one week prior to the event.

How old do I have to be to claim my prize?

To claim a prize, you must be at least 18 years of age. In the event a winner chooses not to accept a prize or the prize is not claimed within the 30-day period, the winner forfeits all claims to the prize.

Where do I collect my prize?

Prizes can be claimed any time after being won, unless stipulated otherwise, by visiting Surge 105 – CKHY at 100 Main Street, Dartmouth, during our office hours: Monday to Friday 8:30AM- 4:30PM, except when the office is closed due to statutory holidays. Surge 105 – CKHY cannot be responsible for mailing prizes.

General Rules and Regulations

Eligibility:

Surge 105 – CKHY associated sponsors, employees, and their immediate families are ineligible to participate in any Surge 105 – CKHY contests.

This contest is open to anyone who is a legal Canadian resident, age 18 or older.

There is no purchase necessary to enter the contest.

When can I win again?

Prize value to $500 – 30 days

Prize value above $500 – One winner per household, per year.

General Contest Rules

1. Surge 105 – CKHY reserves the right to discard any entry that is not deemed legible.
2. Copies of these rules and regulations are available free to the public at Surge 105 – CKHY, 100 Main Street, Dartmouth, during regular office hours: Monday to Friday 8:30AM- 4:30PM, except statutory holidays. They can also be found on our website at www.surge105.ca
3. The odds of winning a prize depend on the number of entries received during the contesting dates.
4. Surge 105 – CKHY reserves the right to use the name, likeness, entry letter, photo, and/ or recorded voice of any participant of any contest for promotional purposes without providing compensation for doing so.
5. All federal, provincial, and local laws apply to all contests.
6. Participants agree to indemnify and hold forever harmless Surge 105 – CKHY, participating sponsors, employees, and affiliates for any injuries, accidents, and misfortunes, including death, which arise from participating in any contest and/ or acceptance of the prize. Participants have entered the contest at their own risk, and agree to hold nobody responsible for injuries or misfortune with regards to participation.
7. Winners shall be responsible for all costs and expenses not explicitly stated to form part of the prize, including but not limited to taxes, fees, insurance, and gratuities.
8. Surge 105 – CKHY does not assume any responsibility for technical malfunctions, human or technical error, delayed or incomprehensible data or transmissions, incorrect capture of entry information, or failures of any telephone or computer line or network, computer equipment, or software.
9. Where the prize includes travel, the prize winner must ensure that he/she and his/her companion have all the necessary travel documents, including a passport, required to travel to the destination on the dates specified in the prize description. Surge 105 – CKHY cannot be held responsible for a winner not having the required travel documents.
10. Surge 105 – CKHY reserves the right to cancel a contest or disqualify any participant if, in the station’s sole opinion, due to fraud, technical failures, or human errors, the contest cannot be held as originally planned by the station and associated sponsors. Any person entering the contest in such a way that it will corrupt the fair and honest conduct of the contest or could interfere with any other contestant’s chances of participating or winning will be disqualified.
11. In the event of any discrepancy or inconsistency between the rules and regulations noted above and specific rules pertaining to a contest, the specific contest’s rules shall prevail, govern, and control. The decisions and rule interpretations of all rules and regulations are exclusive to Surge 105 – CKHY and are final. Surge 105 – CKHY reserves the right to supplement or change contest rules at any time.
